By creating an account, accessing, or using the Elio platform ("Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms that apply to specific features. If you do not agree to these Terms, do not use the Service.
We collect your date of birth at registration and use it to verify you meet the 18+ minimum age requirement. We may request additional verification at any time. Providing a false date of birth constitutes a material breach of these Terms and may expose you to legal liability. We will delete all data associated with any account found to belong to a minor.
The Children's Online Privacy Protection Act (COPPA) prohibits the online collection of personal information from children under 13 without verifiable parental consent. Because Elio processes biometric and health data, we apply a higher standard: we do not permit use by anyone under 18, and we do not knowingly collect any personal information from anyone under 18. This exceeds COPPA's minimum requirements. If you are the parent or guardian of a child under 13 who has submitted personal information to Elio, please contact us immediately at support@elio.com and we will delete all associated data within 72 hours. We do not condition participation on a child disclosing more information than is reasonably necessary.
Under the EU General Data Protection Regulation (GDPR) Article 8, the minimum age for a child to consent to the processing of their personal data for information society services is 16, unless a Member State has legislated a lower age (minimum 13). EU member states set their own thresholds within this range (e.g. 16 in the Netherlands and Germany; 15 in France; 14 in Austria and Italy; 13 in Denmark and Sweden). The UK sets 13 under the UK GDPR and enforces high standards for services likely to be accessed by children under the UK Children's Code (Age Appropriate Design Code). Because Elio processes special-category biometric and health data and its analysis of physical appearance carries psychological risk, we apply a uniform 18+ minimum globally — well above all applicable thresholds. We do not rely on consent from anyone under 18 for any processing. If you are located in the EU or UK and believe a minor has used Elio, you have the right to contact your national Data Protection Authority (DPA) or the UK ICO in addition to contacting us.
If we become aware that a user is under 18, we will immediately suspend their account, delete all associated personal data, and notify the user by email of the reason for termination.

We will never sell your biometric data to third parties. We will never use your facial images to train AI models without your separate explicit consent. Your images are stored solely to enable your own progress tracking — for no other purpose. You may delete any or all of your images at any time through your account settings, or by contacting support@elio.com. All images are permanently deleted within 30 days of account closure.

Body Dysmorphic Disorder is a recognised mental health condition characterised by obsessive preoccupation with perceived flaws in physical appearance. Appearance-focused analysis tools like Elio are contraindicated for people with BDD. Use of this Service by someone with active BDD may significantly worsen symptoms, reinforce distorted self-perception, and cause serious psychological harm. If you have been diagnosed with BDD, or believe you may have BDD, we strongly advise you not to use Elio without first consulting a qualified mental health professional.

Services that focus on physical appearance and body optimisation can be triggering for people with eating disorders including anorexia nervosa, bulimia nervosa, binge eating disorder, and orthorexia. If you are currently affected by or recovering from an eating disorder, we strongly recommend consulting a clinical professional before using Elio. Elio's recommendations are not designed for people with clinical eating disorders and should not be used as a substitute for medical or therapeutic treatment.

Elio is designed to be empowering and constructive — to help users understand their health signals and take evidence-based steps toward their goals. It is not designed to make users feel bad about themselves. However, we acknowledge that receiving analytical feedback about physical appearance can be difficult for some people. If at any point using the Service causes you distress, you are encouraged to stop, take a break, and seek support if needed.

Elio reserves the right to suspend or terminate access to the Service, at our sole discretion, if we reasonably believe that continued use poses a risk to a user's psychological wellbeing. In such cases, we will notify the user by email and, where appropriate, provide signposting to relevant support resources. This is not a punitive measure — it reflects our commitment to user safety above commercial considerations.
Elio owns all rights to the platform, AI models, analysis methodology, and content. You retain ownership of any images you upload. By uploading images, you grant Elio a limited licence to process those images solely for the purpose of generating your analysis. We do not claim ownership of your images and will not use them for any other purpose without your consent.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that analysis results will be accurate, complete, or suitable for any particular purpose.
To the fullest extent permitted by law, Elio Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data, health outcomes, psychological harm, or any damages resulting from reliance on analysis results. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months prior to the claim.
